I searched but couldn't find anything on this. I am making a map and was wondering, if I use any textures or models from the 1.0 version, is there a chance I could have legal problems since activision or Valve (not sure which) owns DoD now? I am running the DL version upgrade from 3.1. If there is a thread already about this already I would appreciate the link since I couldnt find anything. Thanks.

You're allowed to do anything you want, just don't package your map and try and sell it.
